May 23, 2006 – With its decree of May 4th 2006, the Amsterdam Court of Appeal confirmed the judgement that was rendered by the court of this same city in October 2004 which had given reason to the UCI and it’s old president Mr. Hein Verbruggen, in the dispute against Willy Voet, doctor of the Festina team in 1998.
The court had defended Voet to declare of suggest that the UCI or Mr. Verbruggen had been linked with the establishment of antedated medical prescriptions for the administration of lidocaïne in the Brochard case, and that they had tried to suppress the facts and circumstances of this same case. The court had confirmed that such allegations were false and illegitimate. At the same time, the courts had ordered Willy Voet to take back those words in his book “Massacre à la chaîne”.
The appeal of Willy Voet against this decision was rejected. The appeals court confirmed its arrest of May 4th that accusations from Willy Voet are not founded, and that such allegations are false and illegitimate and constitute an illicit attain to the reputation of the UCI and Mr. Verbruggen.
Willy Voet was condemned to pay an indemnity of €15,000 each time that he will violate these interdictions as imposed by justice. Moreover, Willy Voet was condemned to pay all costs linked to both procedures.
