OCA Discipline Panel Communiqué

July 27, 2005 – On Wednesday, June 22, 2005 an incident occurred at the Midweek Road Cycling Event at Downsview Park. A letter of complaint was received by the OCA office which enacted the OCA Discipline policy.

As per the policy, a three person panel of OCA members was composed to oversee the proceedings. The members of the Panel unanimously agreed that the following actions occur.

Tim Lefebvre In addition to the disqualification that occurred at the event the following additional sanctions are levied: 1. Pursuant Section 12.1.040.29 of the Canadian Cycling Association Rule Book 2005 and associated Companion Guide, a fine of $100 be levied for “insults, threats, unseemly behavior”, and 2. Pursuant to Section 12.1.040.30 a fine of $100 for an “act of violence” as required by be levied against the rider. 3. Fines shall be paid by August 2, 2005 or the athlete will be suspended until such time as the fine is paid.

In accordance with the “guidelines” established by the “Policy”, and due to the severity of the infractions, the Panel imposes the following:

1. A suspension of one week starting on June 22 and finishing on June 30, 2005; and 2. One day of community service is to be performed at a provincially sanctioned event before the end of 2005.

The Panel recognized that these items fell outside the “Guidelines” within the Appendix of the Policy, however as the sanctions provided within the Policy are only “guidelines” and the actions of Mr. Lefebvre were extreme, the panel found it suitable to provide additional sanctions. It shall also be noted on Mr. Lefebvre’s file that this incident has occurred and shall be considered should another incident occur within 5 years.

Dan Lefebvre In addition to the disqualification that occurred at the event, the following additional sanctions are levied:

Pursuant to Section 12.1.040.30 a fine of $100 for an “act of violence” be levied against the rider. 3. Fines shall be paid by August 2, 2005 or the athlete will be suspended until such time as the fine is paid.

Mr. Lefebvre has been reminded to review his actions with respect to race tactics and riding styles and adjust them according to the level of competition and the sanction level of an event. It shall also be noted on Mr. Lefebvre’s file that this incident has occurred and shall be considered should another incident occur within 5 years.

Jamey Gildiner Although no formal complaint against this rider was received, it is the opinion of the Panel that Mr. Gildiner’s actions may have contributed to the escalation of the incident. His involvement in this incident should be noted in his file and considered should a complaint occur against him in the next 3 years.

Having reviewed and implemented the Ontario Cycling Association Discipline Policy, the Panel will be providing a suggested modification to address similar situations so they may be handled in a manner likely to promote sportsmanship. These recommendations will be provided to the Development Committee for their consideration.
